Professor Gabriël A. Moens

JD (Leuven), LL.M (Northwestern), Ph.D (Sydney), GCEd (Queensland),

Professor Moens is Professor of Law and Director of Research, Curtin University. Prior to his current position he served as Pro Vice Chancellor (Law, Business and Information Technology) and as a long-serving Dean and Professor of Law at Murdoch University. He also served as Professor of Law and Head, Graduate School of Law, University of Notre Dame Australia and as Garrick Professor of Law and Director, The Australian Institute of Foreign and Comparative Law, The University of Queensland. He undertakes teaching and research in Constitutional Law, Banking Law, European Union Law, International Commercial Law, International Arbitration Law and Comparative Law. He also teaches International Business Law and European Union Law at the University of Notre Dame, London Law Centre. Professor Moens is a past winner of a University of Queensland Excellence in Teaching Award. In 1999, he also won the Australian Award for University Teaching in Law and Legal Studies. He is Chief Editor of International Trade and Business Law Review. He is also a member of the Editorial Board of American Journal of Jurisprudence and other scholarly journals. In 2003, the Prime Minister of Australia awarded him the Australian Centenary Medal for services to education. In 1995-1996 he was a Visiting Professor of Law at J. Reuben Clark Law School, Brigham Young University, Utah. He served as a Visiting Professor of Law at Loyola University, New Orleans School of Law in 2002-2003. In 1997 and 2000 he successfully coached the T.C. Beirne School of Law team to win the prestigious Willem C Vis International Commercial Arbitration Moot in Vienna, Austria. He also coached the winning City University of Hong Kong team in the Ninth Willem C Vis (East) Moot in 2012 and the 20th Willem C Vis Moot in Vienna in 2013. He is a Fellow (FCIArb) and Chartered Arbitrator of the Chartered Institute of Arbitrators, London and Fellow and Deputy Secretary General of the Australian Centre of International Commercial Arbitration (ACICA). He is the co-author of a Commentary to the ACICA Arbitration Rules. Professor Moens is also a Membre Titulaire, International Academy of Comparative Law, Paris and a Fellow of the Australian Institute of Management (AIM). In 1998, the Asian Development Bank, Manila retained him to train officials of the Ministry of Law and Justice of his Majesty's Government of Nepal. He has taught extensively in the United Kingdom, Germany, Belgium, Italy, Austria, Australia, Indonesia, Thailand, Singapore, Hong Kong, Japan and the United States. He is co-author of The Constitution of the Commonwealth of Australia Annotated (8th ed, 2012), Jurisprudence of Liberty (2nd. ed. 2011), Commercial Law of the European Union, 2010, and International Trade and Business: Law, Policy and Ethics (2nd ed, 2006).

Biographical Details Professor Phil Evans

Professor Philip Evans BSc.Eng (Merit), ME (Hons), LLB, LGE Cert (NSW), PhD, Grad Cert Tert & Adult Ed, Cert IV Train. & Asses., FIE (Aust), FAIB, FAIM, FACICA, MIAMA Professor Phil Evans joined Murdoch University School of Law in July 2010. Prior to his professorial appointment he was an Adjunct Professor, Executive Director of the Western Australian Institute of Dispute Management (WAIDM) and a sessional lecturer in the School. He was formerly Head of the Graduate School of Law and later Associate Dean of the Notre Dame Australia School of Law. Prior to entering legal practice he was Head of the Department of Construction Management in the School of the Built Environment at Curtin University. After leaving Curtin University he joined the litigation section of a national law firm and later was principal of his own legal practice. Professor Evans is a graded arbitrator, accredited mediator and a registered adjudicator (WA and NT). His teaching and research interests include Trade Practices Law, Intellectual Property Law, Mediation, Commercial Arbitration and Construction Law. He has also coached teams in the Willem C Vis International Arbitration Moot, the International Maritime Arbitration Moot, and the Hong Kong ADR International Moot. He is also one of the three presenters in the WAIDM/Murdoch School of Law Professional Training in Arbitration Law and Practice program and has tutored in the Chartered Institute of Arbitrators Diploma in International Arbitration. Professor Evans is a regular presenter in the both the Murdoch Executive Education and Organizational Capability Unit programs in Contract Administration, Administrative Law and Dispute Resolution. Professor Evans has received a number of Vice Chancellors teaching commendations and was Dean of the Murdoch School of Law from January to December 2011. In 2006 and 2011 he was nominated for an Australian of the Year award for his contribution to tertiary education. In 2012 Professor Evans received the Murdoch Law Students Society Law Lecturer of the Year Award and in 2013 was the recipient of the Vice Chancellors Award for Teaching Innovation. On 1 July 2013 Professor Evans will join the new Curtin University Law School as Professor of Law.

The course is intended for candidates who:

are new to the field of international arbitration and mediation and have not had any legal training;

Introduction

Commercial arbitration and medication is one of the growth areas of international business and trade today. It is also an area that is fast gaining importance and popularity in the domestic and international legal practice scene. Arbitration and mediation is also one of the most widely used dispute resolution methods in domestic and international business, often argued by many to be the only effective recourse for settlement of business differences.

Who Should Attend

The study of arbitration and mediation are CRITICAL today because it is not widely known in the commercial sector. The program offers lawyers, business people and professionals an opportunity to study domestic and international arbitration law. It will also benefit people from multi-disciplinary industries such as maritime, engineering, shipping, construction, trading, insurance, banking, real estate, investment, medical and healthcare.

Key Outcome & Recognition

Participants who pass the assessment will be awarded the “Postgraduate Diploma/Professional Diploma/Professional Certificate in International Commercial Arbitration and Mediation” by Chartered Management Academy. This certificate is accredited to exempt the holder from the Associate Membership/Full Member/Fellow Member* (ACIArb/MCIArb/FCIArb) examination of the Chartered Institute of Arbitrators. Other requirements may apply with regard to membership application and those interested are encouraged to contact the Chartered Institute of Arbitrators (CIArb) in London for details.
